Agreement to Terms

By accessing or using Lista AI, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our service.

Description of Service

Lista AI is an AI-powered list management application that helps you organize shopping lists, tasks, and other items through natural language conversations. Our service includes:

• AI-powered chat interface for managing lists
• Automatic categorization of items
• Cloud synchronization across devices
• Mobile apps (iOS and Android) and web access

User Accounts

Account Creation

To use Lista AI, you must create an account using:

• Email and password
• Google Sign In
• Apple Sign In

Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Service Tiers and Usage Limits

Free Tier

Lista AI offers a free tier with the following features:

• Up to 15 list items
• Basic AI chat functionality
• Access to all core features
• Cloud synchronization across devices

Once you reach 15 list items, you must upgrade to a subscription to add more items. You can continue to use existing features with your current items.

Premium Subscription

Premium subscribers receive:

• Unlimited list items
• Faster AI response speeds
• All features available in the free tier
• Priority support

Subscription and Payments

Subscription Plans

Lista AI offers auto-renewable annual subscriptions with flexible pricing:

• $10 per year (Supporter tier)
• $20 per year (Enthusiast tier)
• $30 per year (Champion tier)

All subscription tiers provide identical features. Choose the price that feels right to support the development and maintenance of Lista AI.

Auto-Renewal

• Subscriptions automatically renew at the end of each annual period
• You will be charged through your Apple App Store, Google Play, or Stripe account
• Payment will be charged at the rate you selected at confirmation of purchase
• Your subscription will renew automatically 24 hours before the end of the current period
• You will receive a notification approximately 2 weeks before renewal

Managing and Canceling Subscriptions

You can manage or cancel your subscription at any time:

• iOS: Through your Apple App Store account settings
• Android: Through your Google Play Store account settings
• Web: Through your account preferences or Stripe billing portal

When you cancel:

• Cancellation takes effect at the end of the current billing period
• You will continue to have full access until the end of your paid period
• After your subscription ends, you will revert to the free tier (15 items limit)
• Your existing list items will be preserved but you cannot add more than 15 items

Refund Policy

• All sales are final
• Refunds are handled according to Apple App Store, Google Play Store, and Stripe policies
• For App Store purchases, contact Apple directly for refund requests
• For Google Play purchases, contact Google directly for refund requests
• For web purchases, contact us at [email protected] within 14 days

Free Trial

Lista AI does not offer a traditional free trial period. Instead, you can test the service with up to 15 list items before deciding to subscribe.

Price Changes

• We reserve the right to change subscription prices
• You will be notified of any price changes at least 30 days in advance
• Price changes will not affect your current subscription period
• If you do not agree to the new price, you may cancel your subscription

Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated systems to access the service without permission
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations

AI Service Usage

Our AI-powered features:

• Are provided "as is" and may not always be accurate
• Should not be relied upon for critical decisions
• May have limitations in understanding complex requests
• Are continuously improved based on usage patterns

You acknowledge that AI-generated responses may occasionally contain errors or misinterpretations.

Content and Data

Your Content

You retain all rights to the content you create (list items, messages, etc.). By using our service, you grant us a license to:

• Store and process your content to provide the service
• Use anonymized, aggregated data to improve our service

Prohibited Content

You may not use our service to store or transmit:

• Illegal or harmful content
• Content that infringes on intellectual property rights
• Spam or unsolicited messages
• Personal information of others without permission

Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted access to the service
• Error-free operation
• That the service will meet all your requirements

We may modify, suspend, or discontinue the service at any time with reasonable notice.

Intellectual Property

Lista AI and its original content, features, and functionality are owned by us and are protected by:

• Trademark
• Patent
• Trade secret
• Other intellectual property laws

Account Deletion

You may request account deletion at any time through:

• The app's preferences/settings screen

When you request account deletion:

• Your account will be marked for deletion immediately
• You will have 30 days to cancel the deletion request
• After 30 days, all your personal data will be permanently deleted
• We may retain certain data as required by law (e.g., transaction records, tax information)
• Anonymized, aggregated data may be retained for analytics purposes

Termination

By Us

We may terminate or suspend your account if:

• You violate these terms
• We are required to do so by law
• Your account has been inactive for an extended period
• We discontinue the service

If we terminate your account, any active subscription will be refunded on a pro-rata basis according to the policies of your payment provider.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of AI-generated content

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions
• Errors in AI-generated content

Our total liability shall not exceed the amount you paid us in the past 12 months.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any rights of another

Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these terms or the service shall be resolved through:
